"Gibbs, came into his store together. Gibbs bought some sugar, and presented an order ©f Aldrich's upon witness for L 8 16a Bd, in payment. Witness told Gibbs that he would take the amount of the order off his account, Gibbs at the time owing him L9 8s 6d for goods. Gib's replied that the order was for talf cash, meaning that half the amount was to be paid in goods. Witness repeated that he would take the amount off Gtbb's account, but if Aldrich would be responsible "Gibbs might have what goods he wanted. Witness retained the order.
Constable T. M. Smith deposed that on arresting the prisoner the latter was wearing the suit of clothes which he had obtained from Mitohenson, and gave up some of the other articles. Prisoner remarked that he did mot care if he got a month or two in Ounedin, as his wife's mother lived somewhere near there, and he could make it all right. The jury, after a few minutes' consultation, returned a verdict of Guilty.
His Honour sentenced the prisoner to imprisonment for 13 calendar months, with liard labour.
The' Court adjourned until 10 o'clock on Wednesday morning.
