The Magistrate said he understood the applicant was now the manager of a brickfield, and his occupying such a position simultaneously with that of landlord of an hotel wa3 contrary to the provisions of the Licensing Act. The applicant must give his undivided attention to his hotel. Mr Ward said the applicant informed him that he had done so. The Magistrate intimated that a report; should be made by tre police, and the application would be postponed for a week. Michael Cox, Dunedin Hotel.—The Commissioner of Police said he had no objection | to the application being granted, but wished j to mention that the applicant "had been fined j for refusing admittance to the police. The : applicant was cautioned, and the application ! granted. Alex. M'llroy, Gridiron Hotel.—The Com- j missioner of Police reported that the appli- ' cant had been fined for drunkenness, and ! that he was subsequently locked, up for wil I fully destroying property. The prosecutor i in the case, however, did not appear. Mr Harris, who appeared for the aoplicant, said that with regard to the first matter he | was not instructed. He did not know what i the circumstances were, but respecting the charge of destroying property, he was instructed that it was without foundation, and that the applicant had already taken proceedings against the other party for illegal detention. When taken the applicant was not drunk nor creating any disturbance. He was taken merely on the accusation of

the other party. The applicant was discharged, and on the following morning fee complainant did not appear. The applicant's house had teen properly conducted, ?n& many of the residents in the neighborhood spoke -well of him, and had made no complaints whatever. : The applicant made a few remarks to the Bench, but as he spoke in a low tone of voice, they were.not he <rd. The Magistrate said the affair referred to might have been an accident. He trnsted it would not occur again, otherwise the license would be refused. Application granted. Patrick O'Brien, Munster Arms.—MrWard appeared for the applicant. The Commissioner of Police re; orfced tnafc the applicant had been fiaed three times for drunkenness Mr Ward replied that the applicant had been a teetotaller for some time paafc A. memorial was before the Bench, but there was nothing against the house. The Magistrate said that 500 memorials would not alter his zniad, nor that of his brother Magistrate (Oapt. Eraser). The applicant's conduct; had been of a gross orden It was unnecessary to read the memorial; Mr Ward certainly thought it was necessary that the memorial should be read, together with the names of the parties who signed ife. If the license were refused, the applicant would-be a loser to the extent of some hundreds of pounds. He had % family to support, and it would be almost too bad if he were punished to the extent indicated-in respect of that for which he had already suffered. He (Mr Ward) here made some remarks in regard to an affair which, happened at the Cemetery, and in which the applicant was said to have been implicated; but they were not distinctly heard. The Magistrate replied that the Bench could not consider wives and families in aucb. cases. He had a duty to perform, andl he always did his doty irrespective of persons or circumstances; This was not an ordinary case. The applicant had been three tiniest convicted for drunkenness, and he thought that any unbiassed person would s^y he was not a pfrson to whom a license ought to: be granted.' Indeed, he should consider that » Magistrate would be forgetting his duly if, after such a statement as the Commisaioneeof Police had made, he granted a license. Reference had been made to the affair at th» Cemetery. The applicant put forward two* ignorant men to do what he dare not d<* himself. He (the Magistrate) told, him, so the next morning—a coward in addition .to | his other qualities. The license wou dbe refused. The applicant said he desired to explaia that he was not the instigator of what took, place at the Cemetery. The Magistrate : I have direct evidence o£ a fact. I have the evidence of witnesses sworn in the box, that you were the instigator of the affair. Bat that is only one offence. Your drunken and disorderly conduct renders you unfit to be the keeper of & licensed house. . Application refused, Thomas Broadway, WestTaieri MrWaHE appeared for the applicant. The Commissioner of Police stated thafe the applicant had been fined for gambling. The Magistrate said he knew the ciramastances of this case ; it was more than am ordinary case. The applicant knew what hs meant, and if such another complaint were made hia license would be taken from him. By allowing gambling to take place in bis house, a young man had been deprived, of & very good situation. Application granted. J. T. Roberts—Application for a license for a new hotel in Albany street, to be crlled the British Tavern. The Commissioner of Police reported that the residents considered an hotel in. thafe neighbourhood was not required. Mr Ward appeared in support of the application, and urged that the objections raised had been made too late. The application was refused. Jam2s Sly, Union Hotel, Caversham—€ta the representation of the Commissioner of Police, who reported that another hotel watt not required, the application was refused.. Adolphe Desmarest;, application for a newlicense for a house to be called the CafS National, in Stafford street.—Mr Warct and Mr Harris spoke in favour of the application^ and Mr Bathgate opposed it.
