RESIDENT MAGISTRATE'S COURT.

Satukday, June 25th. (Before A. C. Strode, Esq., RM.) Drtjnk.—Patrick Daley, for being drunk, was fined 20s, or 48 hours' imprisonment. Stealing prom the Fiee. —Joseph Mur- ' tbv, the colored shoe-black, was charged with stealing two frying-pans from the vicinity of the fire in Moray-place, about midnighj^ on the 2ith inst. The constable met the prisoner at the corner of Bowling and Princes streets with the two frying-pa7>s in his hand, and when asked where he got them, he said he got them from a friend, and afterwards confessed that he had stolen them from the fire. Prisoner was sent to j gaol for three months with hard labor. I Opening Footpaths. - Stephen Hutchinson, engineer of the Gas Company, was charged on an information by the Inspector of Nuisances, ■with removing the surface of the footpath in Moray-place, without permission of the local authority. The complainant stated that he had received instructions from the Clerk of the Town Board to summon the defendant, because be had -no permission to lay ninins within thirteen feet of the building line. Defendant pleaded that the' summons had been taken out under a mis-ap-prehension that the pipe whi^h he was laying in Moray-pace was a main, whereas it was only a service pipe leading from the main to the Congregational Church. He had permission from the City Engineer to open up this footpath. '1 he Magistrate could not recogDise the City Engineer as the local authority, and r.dvised the defendant to obtain from the Town Board a definite statement of how far they permittel him to open up footpaths, and for what purposes. As no authority had been shown for opening this footpath in Moray-place, he would fine the defendant 10s and costs.
