BY DEED, dated the 14th day of June, 1864, made between George Gemmell, of Dunedin, in the Province of Otago, builder, of the first part, and Allan Gait, of Dunedin, timber merchant, and Andrew Lees, also of Dunedin, psinter and glazier (creditors of the said George Gemmell), of the second part, in pursuance of a resolution passed at a roeefiug of the creditors or the said tfeorge Gemmell. The said George Gemmell did assign unto the said Allan Gait and Andrew Lees, all and singular the estate and effects whatsoever and wheresoever of the said George Gremmell, to be appiied and administered by the said Allan Gait and Andrew Lees, for the benefit of all the creditors of the said George Gemmell, rateably and proportion ably, according to the amount of their respective debts, and without any preference or priority, and to pay any surplus monies (if any) to the said George Gemmell. s All debts due to the estate are to be paid to the trustees.
