Bailev, S.M.. gave" his reserved decision in the case in which, the licensee of the Royal Hot-el was charged with exposing liquor for sale after closing hours. The circumstances were that- three men were found by the police in the tan room adjoining the bar. which was lighted. The defence alleged that- one man was. a lodger and the others were guests: and were taken to the tap room whije another maft used the telephone, which was in a sit ting room onening off the bar. and the only othen door which led to the backyard.. The magistrate commented adwprsely on the structural arrangements of the hotel. He was satisfied as to the bona fides of the men, and held that the exposure of liouor to them was not exposure for sale. The information against the. licensee and the three men for being found on the premises after hours were all dismissed.
