On the application for a writ of habeas corpus, tho Court ordered the release ol liazelton, the Solomon Island trader and ex-Assistant-Commissiouer, who was arrested a few days ago at the instance of Mr Oliphant, Acting-Resident Oommissioner at the Solomons. All* Oliphant s affidavits set out that he had received information that liazelton was trallicking in arms at the Solomons, lie issued a search warrant and a search discovered arms aboard tho schooner iiazelton was running. He then issued a summons against iiazelton and visited his schooner to obtain certain data. liazelton threatened that he would bo thrown overboard if ho came aboard without showing authority and, catching Oliphant's arm which was resting on the gunwale, shoved him back into the boat. Oliphant issued a warrant for the arrest of iiazelton on a charge of laying hands oil, threatening, and openly insulting, his Britannic Majesty's Acting-Ucsi-dent Commissioner of the Solomon protectorate and Deputy-Commissioner of the Western Pacific. Mr Oliphant, in his capacity aa a magistrate, tried tho case himself, and sentenced iiazelton to pay a fino of £lO, or servo three months' imprisonment at Fiji, directing him to pay his own expenses of removal to Fiji. Both camo from tho Solomons on tho samo steamer. On reaching tho Brisbane River Oliphant issued a new warrant for tho detention of iiazelton, who, on tho arrival of the steamer at Sydney, was placed in tho lock-up on the strength of the Brisbane warrant, pending his removal to i'iji. Justice Cohen ordered his release, on tho ground that Oliphant, in issuing the Brisbane warrant, acted outside the territory wherein ho had jurisdiction.
