Mr Juatico Coopor to-day gave judgment on a summons arising out of the action in: connection with the Kotomaliana—Jossio Nicol collision, relating to the production of cortain documents essential Uf plaintiff <Cook) in his claim against tlio Union Company. The defence was that tlio documents are from the servants of tlio Company made for the uso of the Company and their solicitor, in anticipation of litigation. His Honor ruled that documents which came into existence after nn notion was threatened and which wore made for the use of the Company's solicitor, wcro privileged. LYTTBL.TON. May 25. Arrived, at 9.40 a.m.—Waikarc, from Dunedin. NAPIER. - May 25. Thomas Morgan, headmaster of the Napier Main School, died early this morning, aged 53. Tho deceased was an able teacher, and while he was in cliargo of tho Gisborno school one of his pupils took first pltieo in the Crystal Palace engineering exam'mation in 1898. Another very old resident in Dr Menzies passed away, agod 84. Doceased went all through tho Crimean war, and retired on a, pension from the army in 1872, with the rank of Inspector-Goiieral of Army Hospitals. Shortly after coming to Napier he was appointed resident surgeon of the hospital, from which position he retired in 1896, owing to advanced age. At tho Supremo Court John Joseph Dover, who pleaded guilty to breaking and entering and theft, was sentenced to 18 months. The second trial of Henry Dennett, Joseph Winters, and James Hugh Cloary, on a cliarge of theft, in which the first jury disagreed, is now proceeding. GISBORNE. May 25. A shop and dwelling, owned and occupied by James East, in Uppor Gladßtono Road, was destroyed by firo at midnight. Tho Record Reign Hotel, adjoining, had a, narrow escape. East's insurances amount to £BSO in tho North British and North Gorman offices, the loss being considerably above that amount. At tho Borough Council meeting last night a complaint was made that the delay of the Government in giving effect to the amalgamation of Gisborne and suburbs was considerably liampering the attainment of a water supply.
