NO-LICENSE IN MATAURA
(Daily Times Correspondent.) Invercargill, September 16. \t the Magistrate's Court to-day, before Mr S E M'Carthv, S.M., George Demp-ct„-.r. 6 en., hotelkeeper. Woodlands, George Dempster, jun., and Joseph Irwin, fanner, GUnham, were charged on two information* (J.) -with having received an order for whisky on or about the 9th day of July; and 12) with having sold whisky and port wine on the 16th day of July, in each case within the no-license district of Mataura. Mr Stout appeared for all the defendants, who pleaded * k Not guiltv.' Inspector conducted the case forthc prosecution, which was to the effect that & social to Dempster, iun., was held at- 'Edendale on the 15th July, and that Dempster, jun., In J received "an order from the secretary of the social for whisky and port wine to be supplied to the social, and had filled the order, it being alleged that the liquor was obtained from Dempster, sen., and Irwin. It was proved that a case of whisky was consi™ned bv rail to Irwin on the 14th Julv on the order of Dempster, sen. After theevidence for the prosecution, Mr Stout contended in respect of the charges against Dempster, sen., and Irwin that there was no case to answer, and that the same was true with regard to the case of selling airainst Dempster, jun. In regard to the cfiarce of receiving an order against Dempster, jun., lie would call evidence to prove that Dempster jun., simply acted as messenger for the secretarv of the social, and fetched the liquor from Invercargill. The Magistrate upheld Jlr Stout's contention in respect to Dempster, sen., and Irwin, but liefrl that there was a case to answer with respect to both charges against Dempster, jun. He accordingly dismissed the charge against the two first-named, and after hearing evidence regarding Dempster, jun., reserved liis decision.
