Sutherland, an appeal by the hasband against an order to maintain his wife who had married again, believing him to be dead, the appeal was dismissed and the order maintained. In •Tones v. Kirby, an action by a bondsman to recover bail estreated on account of Kirby's flight, the judge said the case was ruled by a decision of the Exchequer Chamber which laid down that a person bailed owes no debt and no duty to the persons who become bail for him. Judgment for defendant. Costs were refused. In the Divorce Court in the case of Roadley v. Roadley, the husband's petition, the decree was made absolute. In Scott v. Scott, the wife's petition a decree nisi was granted. CHRISTCHURCH. August 25. At the Police Court to-day Andrew Kelly and Nicholas Nicholls, two young men, wjere committed for trial at the Timaru Supreme Court for the theft of eight horses, two sets of shaft harness, sis sets of leading harness, and eight horse-covers, the property of William S. Maslin. AUCKLAND. August 24. It is stated on good authority that the four German warships in the South Seas will in future make Auckland their headquarters in preference to Sydney. This will mean a lengthened stay of these vessels in this port. On the next visit of the Bussard she will, it is stated, make a stay here of several months. At the Police Court to-day Victor C. Cooper, a young man, was charged with that on the 11th July last he did attempt to commit a crime by obtaining money by false pretences by authorising and instructing Thomas Henry Bailey (informant) to sell and dispose of on Victor C. Cooper's behalf 800 shares in the Star of Wynyardton Gold Mining Company of which shares Victor C. Cooper was not registered owner, and informant sold according to his instruction and the said Victor C. Cooper cannot deliver and never at any time had any interest in the Star of Wynyardton, Aiter hearing the evidence the case was dismissed.
