PUBLIC NOTICES PUBLIC 'NOTICE is hereby given that at • meeting of the Waitaki County January, 1886; at the County Connoil Chamher, Oamarn, a resolution will be proposed to make the following a by-law, Tic:— DEPASTURING REGULATIONS' FOR THK C UNTY OF WAITAKI. Whereas by subsections 4 and 6 of section 51 of " The Mines Act, 1877," it is enaeted that it shall be lawful for the Governor, subject to the'provisions of tbe said Aot, from time to time to make, alter, amend, and revoke rules and regulations for regulating the depasturing of stock upon any 1 nds within mining districts for which a lease or license for depasturing purposes has not been granted, or has been cancelled or suspended, and .the number of horees or cattle which mayfbe run upon such lands by the holders of minera' rights or business licenses, or of m ning or agricultural leases, or by other persons, and for he issue cf depasturing licenses, and to regulate the fees that shall be paid therefor, aod for imposing penalties in respect to the breach of any such regulations for imposing penalties upon the owners of any cattle illegally depasturing on such lands and for recovering from such owners, in addition to any of the aforesaid penalties, all the oosts and charges incident to the collecting and recovering such cattle : And whereas by section 6 of " The Mines Act, 1877," it » enacted that until the Governor shall otherwise order, every goldfie'd dnly proclaimed or constituted at the time of the commencement of the said Aot, and whereas by section 100 of "The Mines Aot, 1877," it is enacted that it shall be lawful for the Governor to delegate to the Chairman of the County Council in the mining district in which such C unty is situate all the powers vested in the Governor for the purp sea hereinbefore recited, subject or not to any limitations or restrict ons as he may think fit, and in like manner to alter or revoke sueh delegation : And whereas the Governor hath, by ('ele-g-.tion in the New Zealand Gazette of the sth day of June, 1884, in pursuance of the powers and authority for that purpose vested in him by " Ihe Mines Aot, 1887," and subject to its provisions, delegated unto tbe Chairman for the time being of the County Council of Waitaki all the powers vested in tbe Governor by subsections (4) and (5) of section 51 of if The Mines Act, 1877," and bath declared that the powers .u _-_.._ „., .1.-1. i. County of Waitaki for which a lease or license for depasturing purposes has not been granted, or has been cancelled or suspended, that is say. INTERPRETATION'. 1. In these regulations the words " great cattle " shall be construed to mean and inolnde horned cattle, horses and mules, male and female, and their offspring above six months of age, and the word " district" shall mean the depasturing district described in the First Schedule hereto,- and every other district which may be hereafter proclaimed within the County of Waitaki. miners' bight and business license holders hat bun cattle. 2. Every holder of a miner's right resident on any goldtield within tbe county exercising and using such right for mining operations within the county, and every holder of a business license occupying land by virtue of such license within the county, shall be entitled to run five head of great cattle free of asaeaamect fees. MINING AND MINERAL LEASES. 3. The person or persona holding or occupying any land within tbe county under or by virtue of any mining or mineral lease head of great cattle which such persons (if more than five holding or occupying under one lease) shall be together entitled to run shall not be more than five head for every such lease or leases. AGRICULTURAL LESSEES AND DEFERRED-PAY-MENT HOLDERS. 4 Holders of land in freehold, on agricultural lease, or on deferred-payment, within the county may apply to the County Council for a depasturing license for great cattle under these regulation*, but shall not be entitled to run any cattle free of assessment fees. 5. Holders of miners' rights or business licenses, mining and mineral lessees, within th« County, may run cattle therein in excess of the number which they are entitled to run free of assessment fees on obtaining a depasturing license under these regulations; and other persons resident in such County, not being holders of miners' rights or business licenses as aforesaid, may ran cattle within any district on obtaining a depasturing license under these regulations. APPLICATION TO BE MADE. 6. Persons desirous of obtaining a depasturing license mast lodge with the Clerk of , the County Council an application in writing in the form contained in tbe second sobedule I hereto, and deposit therewith tbe assessment and registration fees payable under these regulations. If such application is refused, the assessment and registration fees shall be repaid to the applicant, but not otherwise. applications, how dealt with. 7. If the application shall be to depasture not more than five head of great eattle, exclusive of cattle running fee of charge as hereinbefore provided, or of other cattle for which a depasturing license has previously been granted to the applicant, the Clerk of the County Council may, with the consent and approval of the Chairman, forthwith | ißßne a depasturing license to the applicant; bnt if buo'h application shall be for the depasturing any larger number of great cattle than aforesaid, or f>r depasturing small cattle, the Clerk shall submit the same to the County Council at the next ordinary meeting thereof, and the County Council shall determine whether such application shall be granted or refused. ASSESSMENT FEES. 8. The assessment fees payable.annually under these regulations shall be—For every head of great cattle, 6s per annum'; and when six months or more of the annual period shall have expired, only one-half of the above-named fees shall be charged. DURATION AND POKM 0» LICENSE. 9. lepastnring licenses granted under these regulations shall be signed by the Chairman of the County Council, and shaft remain in force only until the day of 1 next following the date thereof; I and such license shall be in tbe form contained in the third schedule hereto. REGISTRATION. 10. All cattle depastured in- a district under, these regulations, whether running free of assessment or by virtue of a depasturing license, must be branded, and the brands and a description of the cattle must be registered with the Clerk of the County Connoil. The fee for every such registration shall be Is, and a certificate of registration, in the form in the fourth schedule hereto shall be given to persona entitled to run cattle free of assessment fees as aforesaid. REGISTER TO BE KEPT. 11. The Clerk of the County Council shall keep a register of brands and a list of depasturing licenses and registration oertirj* cates issued, with the date of issue and the names of the licensees and certificate holders. The qualification under which any cattle are to be run free of assessment fees, and the quantity and description of stock which each person is authorised Ut depasture, and each register shall be kept in the offices of tbe Waitaki County Connoil, and may be inspected at any time during office hours by the publio free of charge. BRANDS PREVIOUSLY REGISTERED. 12. If the brand described in any application has been previously registered by any other person, the applicant shall amend his application by inserting therein some other brand not previously registered.' ANIMALS BKOHOHTED. 13. So entire animal, being a horse over twelvemonths, or bull, or ram, being over six mon-h« o'd, shall be allowed to beat large within any district, and no diseased eattle shall lie depastured upon nor shall any goats or sheep be allowed at large within any district, and any person or persons who shall tun out or depasture any inch entire animal]
