■-♦ HOW ALIBI PLEA LED TO DIVORCE. An alibi which Archibald Cyril Philpot pleaded when charged at Gisborne with having committed burglary last April led subsequently to his wife, Agnes Lena Philpol. obtaining a divorce at the Auckland Supreme Court. Agnes said that she and her hubby were married m August, 1920, and they lived ln Gisborne. Owing to Archibald refusing to support his wife, she left homo and came to Auckland, where sho had managed to fight her own battles ever since. Detective John McLeod said that Archie Phllpot waa prosecuted at Gisborne last September on the charge of burglary. Accused gave evidence on his own behalf, and said that on April 20. the night of the alleged offence, he spent the evening In the room of Nurse Agnes Smith. He added that it was not tho first nijjht he had so behaved. Tho nurse corroborated this evidence at the time of tho hearing. His Honor: There Im no doubt that adultery has been commlttod. A decree was frranted with costs against the respondent.
