LESSEE’S COSTLY OMISSION LOSES ALL IMPROVEMENTS. (By Telegraph—Special to “Times.”) AUCKLAND, August 7. Four hundred pounds seems a high prioe to pay for a simple omission, but that is what has happened in connection with the expiry of a City Council lease in Ponsonby road. The lease was held by Mrs Jessie Craig, and expired on May 11th, 1925. The terms of the Glasgow lease required the lessee to give three months’ notioe of her desire for a renewal, but only one. week’s notice was given. When this point was raised,/ the city solicitor advised that the coqncil had no power to waive the lateness of the notice,, and would be running a serious risk in doing so. In consequence the council resolved some weeks ago to decline the application, the opinion, however, being expressed by some members that in spite of the oversight on the part of the lessee the improvements still belonged' to her. At a meeting of the council last evening the city solicitor advised that the lessee was not entitled to any compensation for the buildings erected on the leased land. He added that the lessee having lost her right of renewal the property reverted to the council with all improvements absolutely. The parks committee, which had gone into this matter, recommended that the property he offered by auction for lease for a period of 21 years without compensation at upsets to be fixed by the committee. This was adopted. The improvements consist of a cottage erected on the property valued at £4OO.
