Responsibility for the loss of furniture and bedding destroyed by fire in a railway track was disputed in a claim for £54 16s 6d by Edward Abbott, Ltd., against Gerald Haycock and Erie McCoskrie in the Magistrate’s Court. It was stated the Railway Department refused to pay for the goods, and tho extra Is Gd per ton had not been paid with tho freight, to render tho department liable. Defendants ordered’ the goods from plaintiff to be delivered by rail to a customer. Mr McKean, S.M., said he did not think under the circumstances there was any duty implied on the plaintiff, except to hand the goods to the transport company in the ordinary manner. Plaintiff was awarded the amount claimed, with costs.
