BOYD v. CITY
APPEAL COURT’S DECISION. 'Hie Appeal Court on Saturday gave decision in the case John James Boyd v. tho Wellington city, concerning the taking of land at Island Bay for tramway purposes. The action was resultant on a proclamation taking tho land under the Act. Plaintiff’s original chum was for a declaration that the proclamation taking the land was void. The majority of the court deohlml that plaintiff had failed, and .judgment must he given for defendant.
