The prosecution against a member of the Pioneer Sports Club for motorcycle racing on North Beach was dismissed, as the foreshore was held to be below high water mark, and was not a public place within the meaning of section 2 of Police Offences Act, 1!X)8. Defendant was Leonard Poore, and the charge was that on January 12tb he furiously drove a motor-cycle on North Beach. Mr Wyvem Wileon, S.M., in hia reserved judgment given to-day gaid the racing was held on a portion of the beach not vested in New Brighton Borough Council for recreation purposes. It was not a place of public resort open to or used by the publio as of right. Prima facie the Crown was entitled to every portion of the foreshore. In New Zealand matters pertaining to the foreshore of these islands were administered bv the Minister of Marine, and the publio hnd no legal right to the use of the foreshore. The Pioneer Sports Club had obtained the consent and approval of the Marine Department to the holding of the races, and defendant seemed to have heen doing no wrong in competing.
