AN UNFAITHFUL WIFE
HUSBAND ABSENT AT WAR. DIVORCE GRANTED. The petition of a husband for., the dissolution of his marriage on the grounds of his wife’s unfaithful conduct after he had left on active service was successful before Mr Justice MacGregor yesterday. The parties were Guy Shuckburgh Collyns, civil engineer, of Wellington, petitioner, Janey Reid Collyns, respondent, and' James Wallis, commercial traveller, of Auckland, co-respond-ent. The suit was undefended.
Mr C. G. White appeared for the petitioner, who was incidentally granted an interim order for the custody of .the three children of the marriage. The parties resided at Greymouth, where they were married, and lived happily together until tTie petitioner went away on active service. The respondent saw him off at Auckland. Suspicions were later aroused as to _ the wife’s conduct owing to letters received from friends in New Zealand. On his return the husband charged her with adultery with Wallis at Auckland on different occasions.
In evidence, petitioner said he believed his wife and Wallis were still living together as man and wife. A letter was placed before the court in which Mrs Collyns admitted misconduct. Evidoneo was given as to the relations of the parties, and His Honour granted a decree nisi, to be moved absolute after three months.
