A TESTAMENTARY MIX-UP. The matter’of a soldier’s two wills came befoco Mr Justice Salmond in the Supreme Court yesterday, the sei cond will having been discovered only | after letters o (administration had at ready been taken out in regard to the . first one. The deceased soldier, F. M. Jackson, it appeared, had made a will dated June 10th, 1913, and a later will dated December 29thj 1918, both wills being returned to New Zealand. By some error, piobably in filing, the latter will was temporarily mislaid in the I Base Records office, and while it was ! still missing Jackson died*on active service on October 9th, 1919. Jackson’s relatives, knowing nothing of the existence of a later will, took I out letters of administration through the local attorneys of the sole beneficiary under the first will, who was resident in Scotland. When the second will was discovered, its testamentary dispositions were ascertained to be entirely different, and the executor of the second will, the father of the deceased, aeordingly moved in the Suprnr Court for recall of the letters of administration already granted on the first will and for grant of probate of the last will. Mr Justice Salmond made an order as asked for by tho executor. By special request of counsel in this case, the names of the barristers concerned are omitted.
