MEETINGS OF CREDITORS

BANKRUPTS NOT PRESENT “S.OMETHING MUST BE DONE,” SAYS ASSIGNEE. PROCEEDINGS ADJOURNED. A meeting of the creditors of John Charles Troy, 47, Ghuznee street, Wellington, carrier, was held yesterday morning, Mr S. Tansley, Official Assignee, presiding. The bankrupt had put in a written statement, which set out that he had resided in Wellington for seven years past, and had been, a tram conductor for two years. After that he became a grocery storeman, and had been a carrier for the past tine© years. With two partners named Quaid and Menzies, Troy set up in business in September, 1920, as the Colonial Produce and Agency Coippany, carrying and selling fruit, vegetables, and sp on. No deed of partnership was drawn up, and tips bankrupt at the time had no means, but he held a motor-car on a hire-purchase agreement, on which he had paid some £IBO. Success did not attend the partnership, quarrels followed ; Quaid left oh© firm and took legal proceedings against his late partners, obtaining judgment for £96 10s. Tile bankrupt said that' he had been unable to meet this, and the motor-car was seized by the vendors, Messrs Sutherland and Rankin. Later, however, they hired it to his wife. Hie was using the car, but only making bare living, eked out by his wife keeping boarders. They bad four children, and liis wife was not at all strong. The liabilities were scheduled at £l7O 5s 6d, with no assets. Charles Quaid (£96 10s), G. Groves, motor mechanic (£l9 17s 6d), G. Brown, dairyman (£ls), the Ceylon Tea Company (£l3), and J. Newman (produce merchant, Auckland X£l9) were the principal creditors. Tlje bankrupt failed to put dn an appearance, but was represented by counsel (Mr P. J. O’Regan), who said that Troy was “too busy to he present.” The Official Assignee pointed ouft that under the Act the bankrupt was compelled to attend the meeting of creditors. The meeting was adjourned till 11 a.m. on Tuesday next. A BUILDER’S CASE. BANKRUPT TOO ILL TO ATTEND. A meeting of the creditors of L. J. Murphy, of Wellington, builder, was held yesterday afternoon. The following were the creditor*!— C..Slymon, timber merchant, £220; Dominion Ferrolite Co., Melling, £62; S. Johns, joiner, £9O; A. J. Monro, hotel proprietor, £2O 16s lid; Wellington Gas Co. ; £26 6s 6d; R. Johnstone, electrician, £24; Marshall, plumber, £24; C. H. Dement, bricklayer, £ls; Carrara Ceiling Co., £24; Briscoe and 00., £6O; Odlin and Co., £3O; total, £602 3s sd. The Official Assignee stated that no papers had vet been put in, and there were, he understood, no assets. The bankrupt did not appear. Mr HT H. Cornish, who appeared on behalf of Murphy, stated that his client was sick and could not attend the meeting The papers had been made out, but the bankrupt was in a state .of collapse, through worry, it seemed, and was not able to sign them: The Official Assignee said that the bankrupt had failed to put in an appearance that day. The Act required the debtor to attend, and steps would have to he taken to prevent that sort of thing. ■Mr Cornish assured the Assignee that Murphy was. quite unable to attend, and Mr Tansley said that under the Act sickness might be accepted as an excuse for non-attendance. One of the creditors said that it was extremely rough on the top of their other losses to bring six or' seven of them there, all pulled away from their work, for nothing. . The meeting was adjourned till 2.30 p.m. on Thursday next., Mr Cornish sand that he was very sorry that the creditors had had to attend to no purpose, and assured them that the papers would be ready next week.
