CLAIM FOR RENT
A FEATHERSTON FRUIT SHOP. PARTIAL JUDGMENT FOR PLAINTIFF. In a claim to recover the sum ot £32 16s as rent -alleged to be due in respect to a shop occupied by defendant, A. Levy, Ltd., clothing manufacturers (Mr P. W. Jackson) proceeded against Peter Nicholas Branigan, fruiterer, of Feathersion (Mr D. M. Findlay), before Mr F. K. Hunt-. S.M., in the Magistrate’s Court, yesterday. The plaintiff claimed the amount aa rent of a shop at Featherston occupied by the defendant from October Bth, 1919, to October 29th, 1920, at a weekly rental of 12s 6d. The* defendant counter-claimed, aL logins that be had expended the amount of £32 10s on the premises at the request of the plaintiff, in order to eomply with the instructions of the tamp commandant in connecting the premises with drainage and water_aup» ply. It was stated that the plaintiff screed to pay the amount claimed, namely, £32 16e. Plaintiff maintained that, in respect to the counter-claim, > Branigan gave the plaintiffs the option of paying for the installation of the drainage and water supply or reducing the rent. At the conclusion of the evidence. His Worship gave judgment for plaintiff for the sum of £5 costs, but in the counter-claim he considered that defendant had not proved that such a contract had been made, and therefore dismissed the counter-claim. Costa were allowed the plaintiff in each instance.
