TWO RESERVED JUDGMENTS.
The 'judgment has been filed in- a suit brought^. by Richard .and' William Sevan against George, Thomas, and Robert Beyan, and others, and the Public Trustee. The court was asked to answer certain questions regarding a lease of land. His Honour held that, under agreements made upon the - death or bankruptcy of Edward Bovan, the lease was to be sp modified, that the_ rent payable thereunder, tbould bo 5 per cent, upon the Government valuation of the properties included in lieu of a rent of £l5O a year as originally arranged. His Honour further held that the parties had no rights against Robert Bevan in respect to. land purchased by him from Hakeraia To Whena or his successors. At the hearing, Mr O. H. Treadwell appeared for. the plaintiffs, and Mr M. Myers for the defendante. : Hr Justice 1 Hosking, in the Supreme Courts yesterday, -mentioned the ease of Christian Hare, ' slieopfarmor, of Cheltenham, against Sidney Frank Perrett, farmer, of Palmerston North. In this base the court was asked to dooide the question of responsibility in regard to a grazing lease, which had been disposed of to the plaintiff, with an undertaking to get a consent to sublease from the original holder. The defendant had 'undertaken to obtain the sanction of the Raumati Syndicate, and the consequence being that the plaintiff had to go out of possession. His Honour held that there-had been a breach of undertaking, but decoded that in regard to damages for the remaining portion of tho lease he would hear further argument. At tho original hearing, Mr T. Neave appeared for tho plaintiff, and Mr C. Loughnan, of Palmerston, for the defendant.
