PUBLIC NOTICES. WELLINGTON CITY CORPORATION. DAY'S BAY SANITATION AND WATER SUPPLY BILL. NOTICE is hereby given that it in the intention of the Wellington City Council to introduce in the next ; ensuing session of Parliament the Day's Bay Sanitation anti Water Supply Bill. Tho objects that the said Bill is intended to effect are-. 1. To include within the jurisdiction of tho Wellington City Council for the purposes of drainage and water supply the settled portion of Day's Bay and the Recreation Ground situate at Days Bay which lands are a portion of the llutt County and are described in the Schedule to the said Bill and delineated on the plan hereinafter referred to and therein edged green. The said area contains 101 Acres and is part of Sections 31 -and 33 Block XVI Belmont Survey District. ■ , - 2. (t) To provide ..that the By-laws of tho City relating to waterworks and water supply, ’ to" drainage and drains whether public or private, to the prevention or suppression of nuisances and tho care and preservation of public health should apply to this area, and that the Wellington City Council should have power to make further By-laws for the same purposes in such area. (2rrTb"ptovldc‘that such By-laws shall be'-in-addition to the By-laws of the Hutt County Council relating to such matters, and that in case of conflict the Bv-lawa of the Wellington City Council shall prevail. . . . (3) To provide that the provisions of tho Municipal Corporations Act, two. relating to tho making, enforcement proof mid mode of testing By-laws and to the effect of penalties under such Bylaws on penalties inflicted by other statutory provisions should apply to Bylaws so made by the Wellington City Council. 3. To provide that the Wellington Cm* Council mar raise within tho area aforesaid special loans for drainage works and waterworks and that the. Local Bodies’ Loan Act should apply to such loans and further that all rateable land within such area should be subject to alt "special rates made and levied in respect of special - lofitis so raised by tho Wellington”'City 'Council and that no such land whatever should be exempt from such rating. 4. To provide that the proceeds of any special rote mnv be applied in part towards payment of cost ot the administration of the Act by tho Wellington City Council. 5. To provide that the Wellington City Council may make and levy separate rate for maintenance, etc., of drainage works* 6. To provide that the proceeds of any snecial rate for waterworks loans may be applied in part towards payments of tho cost of administration ot the provisions ot this Act relating to waterW< L (1) To provide that the Wellington City Council shall make and levy in such area the same water rates and charges as are levied in the parts of the Guy ot Wellington that are supplied by the gravitation system. - (2V To provide that the proceeds of such water rates and charges shall be applied in payment of (a) the cost ot administration of the provisions of the Act relating to waterworks or water supply; (b) the interest, sinking fund and other charges of all loans raiscd under the Act for waterworks or water supply, and that the balance (if, any) of such moneys shall be deemed to bo moneys of the City accruing from waterworks. (3) So long as the proceeds of water rates and charges to made and levied shall be sufficient to meet such lastmentioned costs of administration interest, sinking fund, and charges, no special rates for waterworks loans shall be ß. (1) To provide that the costs, charges, and expenses of the Wellington Citv Council and the Hutt County Council in connection with the preparation and passing of the Act shall be paid out of the first drainage loan. (2) To provide that if the voters refuse to authorise either the first loan for drainage works or the first loan for waterworks the Act shall be void, and the Hutt County Council shall pay to the Wellington City Council all moneys expended in connection with tho preparation and passing of the Apt and all costs and expenses incurred in connection with taking polls for loan proP (3) To provide that if the Wellington City Council makes any claim for such moneys from the Hutt County Council tho claim shall bo in writing, and shall set out in. reasonable detail the several charges making up the claim; that such claim may be taxed by the Registrar of the Supreme Court- at Wellington, and that the allocatur of the Registrar shall be - sufficient authority for tho Hutt County -Council to,.colleet the amount allowed from the ratepayers in the said area. , (4) To provide that the amount so allowed by the Registrar, together with tho cost of collecting the same, shall be a charge payable by means of a rate upon the said area; that on receipt of the,allocatur, of,-the Registrar the Hutt County Council shall forthwith by resolution make and levy on all rateable property in the said area and on the basis of the unimproved value such a rate as will return to tho Council the amount of the allocation, together with five pounds per centum for the cost of collection; that such rate shall be payable in one or more sums; that such resolution shall state such rate to be an amount in tho JB on the rateable value of property in the said area; that such rate shall have the incidents of a rate mado under Part V. of tho Counties Act, 1908; and that it shall not be necessary to give any public notification in respect of such rate under Section 50 of the Rating Act. 1908. 10. To provide that fines imposed under By-laws made under tho Act bo recovered summarily and be paid to the Wellington City Council. 11. To provide that tho area shall not bo affected further than is necessary for the purposes of the Act, and that public Acts shall be read subject to the dot. A copy of the above Bill and a plan of tho land affected thereby have been deposited at the -Magistrate’s Court Office, Lambton quay, Wellington, and also at the Town Clerk’s Office, Town Hall, Cuba street, Wellington, and are there open to public inspection for a period of three full weeks from the first publication hereof.
