A sequel to a case heard in the -Magistrate’s Court on June Sth occurred in the. same court yesterday, when before Mr D. G. A. Cooper, S.M., Frank J. Barton, circus proprietor, preceded against Fred Leonard and Olive Leonard, of Palmerston .North, circus performers, for recovery of the sum of £6 10s, expenses incurred in the action in question. On that occasion the present defendants proceeded against the plaintiffs for the sUm of £9, the amount of two steamer fares from Wellington to Sydney which the defendants alleged were payable by the plaintiff at the termination of their agreement with him. Defendants swore that they were returning’to Sydney forthwith, and judgment was given in their . favour. ' The defendants did not proceed to Sydney, and therefore plaintiff sued them for costs incurred m .the action. Judgment was given for plaintiff for the amount claimed and costs £3 3s. Mr H.
