OXENHOPE APPEAL CASE

Press Association. CHRISTCHURCH, February 9. The New Zealand Racing Confer§nce considered the appeal of A. MeAnlay, trainer of Oxenhope, against the decision of the Dunedin District Committee in endorsing the decision ot the Dunedin Jockey Club disqualifying McAulay, E- Amyes (owner), J. 1Humphries (jockey), .and Oxenhope for two years for an obvious pun. Ihe judges decided that tb© decision of the Dunedin Jockey Club on an obvious pull was not open to review by them, but they had no reason tp question the Justice of that decision. They considered that the question of complicity of the owner or trainer in such an act was one of inference from the attendant circumstances and the evidence being procurable they therefore had power to entertain an appeal by the owner or trainer. In this case they were not satisfied there was evidence of complicity of the trainer, McAulay, and upheld bis appeal. The Judges (Sir George Clifford, Messrs Hugo Friedlander, and B, Lane) adjourned the appeal of Amyes in the same matter for production of further evidence.
