Air P. E. Baldwin appeared for the plaintiff, and Mr'C. Bi Morison, with Mr P. 11. Cooke, for the defendant; board. In the statement of claim filed in the Supreme Court- it was set out that Pcarco is the owner of land in tho drainage district of the Aorangi Land Drainage Board, and also of lands in tho district of the Hanawatu Board. It was alleged that the defendant board had negligently diverted into certain drains a greater quantity of water than the drains were capable of conveying, and had also increased the quantity of water without providing additional means for conveying it. A further allegation was that tho board had allowed the drains to fall into disrepair, so causing them to overflow and do injury to Pearce’s land and stock. In respect of Hiese injuries he claimed .£2OO damages and a mandamus compelling tho board to clear the drains. Certain points of law were, removed into the Court of Appeal for argument 'nd, for the purposes of argument, tho following admissions were made:—That the main drain was on land taken by tho heal’d under the- Public Works Act: that the board was incorporated in 189-1 ami had since that date had the control and management of all the drains; that prior to 389-1 all the drains complained of existed and had been made by the Government of New Zealand. Tho questions for tho court to decide were: Whether plaintiff had a common law right for damages: whether ho -hould proceed by a claim for corapensh;ion: or whether ho- should applv for a mandamus compelling tho board to clear tho drains.
