ALLEGATIONS OF FRAUD

A- COMPLICATED DEAL IN TIMBER* A case in which fraudulent representations were alleged in connection with the purchase of a quantity of timber for building purposes was heard at the Magistrate's Court 3 T csterday, before Dr McArthur, S.M. 1 Prouse Lumber, Ltd., sued C. G. Johann, contractor, lor, damages lor alleged fraudulent representations, amounting to £65 ;Oa Bd, being the value of timber supplied bn the strength of such representations. . 'I . ■ . Mr T. Weston appeared for the plaintiffs, and Mr A. Duun-for'the defendant. SUMMARY. OF THE CASE. The plaintiffs' caee was that at about the beginning of December last year defendant represented to the plaintiffs that Oscar Jorgensen, a contractor, iuvcl obtained a contract in his own name from a Mr Fitzsimmons for. the erection of a building at Muntai, and that Jorgensen required timber amounting to £OS 14a £kt lor thelarcoUon of the building. Belying on these representations plaintiffs supplied the timber. ' Oscar Jorgensen did not pay for the timber; he became insolvent, and plaintiffs learnt that defendant and not Jorgensen find the contract for the build, in-g, and was paid for erecting it by Mr Fitzsimmons.

.Defendant denied, the allegations of fraudulent representation, and maintained Th a t the whole ...transaction : was t bona, fide n also that if there were any misrepresenta--tions made they occasioned no loss to the plaintiffs. After hearing lengthy evidence his Worship adjourned tho case till to-morrow to allow the deed of assiemment of Jorgensen's estate to be produced.
