Weston appeared for the plaintiffs, and Mr A. Duun-for'the defendant. SUMMARY. OF THE CASE. The plaintiffs' caee was that at about the beginning of December last year defendant represented to the plaintiffs that Oscar Jorgensen, a contractor, iuvcl obtained a contract in his own name from a Mr Fitzsimmons for. the erection of a building at Muntai, and that Jorgensen required timber amounting to £OS 14a £kt lor thelarcoUon of the building. Belying on these representations plaintiffs supplied the timber. ' Oscar Jorgensen did not pay for the timber; he became insolvent, and plaintiffs learnt that defendant and not Jorgensen find the contract for the build, in-g, and was paid for erecting it by Mr Fitzsimmons.
