COURT OF APPEAL

(Before their Honors Justices Williams, Derniston, Edwards, Cooper, and Chapman). FEILDING BOROUGH v. THE GAS COMPANY. Mr H. D, Bell, K.U., and Mr C. P. Si-errett K.C., with them AD J. Prior (of Feilding) appeared for the Borough Council; the Hon. Dr Findlay, with him Mr H. F. Von Haast, for the dofendant company. The case has already been described in, our columns. The Court is a&ked to determine whether an agreement entered into between . the plaintiff Borough Council and Messrs Walter Fell and John Moore Richardson, enabling those gentlemen to establish gasworks at Feildins, and authorising them to supply gas to the borough, is valid, and whether the subsequent assignment of Messrs Fell and Richardson’s business, and of the rights, privileges, and advantages of this agreement with the plaintiff company to tho present defendants is valid in law. On Thursday and Friday last Mr Bell had opened the case for the'plaintiff borough and the Attorney-General commenced his reply. Dr Findlay’s argument continued until tho luncheon adjournment to-day. Mr Von Haast followed at considerable length, and Air Skenrett commenced his reply on behalf of tho plaintiff borough. His argument was interrupted by tho adjournment of the Court.

The Court at 4.45 adjourned until 10.30 on the following day.
