CITY LICENSING COMMITTEE.
APPLICATION FOR WHOLESALE LICENSE REFUSED.
Tho City Licensing Committee mot yesterday to further consider tho application of Alfred Kbenezor Schultz for a wholesale license. Dr A. McArthur, S.M., presided, and tho other members of tho committee present wore Messrs A. Hoby and R. Wright. Mr Kirkca-ldie, who appeared in support of the application, explained, tho position, which is somewhat involved. It appears that the owner of the. promises in winch Mr Schultz intended carrying on tho business of a wino merchant, if his application was granted—a Mr Jameson—had up to last December leased tho building to Kelly Son. Tho latter in turn, transferred to Schultz in tho month stated, Schultz being under tho impression that ho was to carry on the wholesale license as Kelly and Son's agent up to tho annual .licensing mooting. In February, however, Kelly offcicted what was really a transfer of tho license to Mr W. A. Kennedy, who is now carrying on business elsewhere m tho city. Mr Kirkcaldio urged, in support of tho application, that his client had purchased the stock when he cn* ;r----od into possession of the premises, and fully believed that the license was to continue.
Mr Campbell addressed the. committee on behalf of Mr Jameson. Tic stated that tho transfer of the alcoholic license to Mr Kennedy was done without knowledge on tho part of his client. Tho consent of tho transfer from Kelly and Son to Schultz was signed, ho alleged, on tho express understanding that the wholesale business would-continue to bo earned on. Counsel stated that holders of wholesale licenses had conducted business in the premises for upwards or thirty years, and in this connection it was woU to note that- section 133 of tho Aab gavo tiro owner of the promises a certain interest in tho matter, though a wholesale license was, strictly speaking, issued in respect of an individual. Mr Levi, who was present •to' watch the proceedings on behalf of Kelly and Son, said ho did not-wish to oppose tho license, bub it was absolutely untrue tliat Schultz had paid anything in respect of tho license itself. Tho committee, after considering the application, intimated that it was not intended to grant any new wholesale licenses on the grounds that the iccjuucments of the city in this respect were already sufficiently served.
