COURT OF APPEAL

At the opening of the Court of Appeal sitting yesterday, the Bench was occupied by Mr Justice Williams, Mr Justice Conolly, Mr Justice Dcrmiston, Mr Justice Edwards and Mr Justice Cooper. On the application of Air T. F. Martin, leave was given to set down the case l Corporation of Wellington v. Johnston and another. Mr J. P. Campbell mentioned that tho case Onehuuga Borough Council y. Manukau Water Supply Board was in coursel of settlement. Mr Justice Williams, after the list had been gone through, said that as to the Christchurch cases the Court could not say that they would not bo taken before Monday next. Tho Court would take any business that it was practicable tc. take this week. If the other business extended to Monday next, then the Christchurch cases would riot bo taken before then. But if the ether business was disposed of earlier, then tho Court ( -would oxpclot the Christchurch counsel to be in attendance earlier. The rule of the Court hitherto had been that foreign cases should bo taken first. For bis own part be did not know why Christchurch counsel engaged "in cases on the list were not present on the opening day of the sitting on this occasion. Mr Justice Conolly pointed out that there wore five Christchurch cases on tho list. A preliminary motion in the case SoU-citor-Genoral v, Wallis and others was argued. Mr Myers mentioned that the Solicitor-General would lead him and appear on the argument of the case. Argument was afterwards begun in tho case McPhee v. Wright, Stephenson and Co. Tho next cases-to bo taken are those cf Jackson v. Wellington Qohege Governors and Eiddler and others v. Mew, both of which are Wellington cases.
