THE LILLYWHITE CASE.

FUTURE COURSE OF ACTION. The point in dispute between the Chief Justice and Mr Justice Edwards in regard to the Lillywhite case is, shortly, this;—The Chief Justice is of opinion that the Court cannot- go into tacts on a motion of habeas corpus and determine whdther there is sufficient evidence to warrant Lillywhite’s being sent Home. Air Justice Edwards, on the contrary, holds that the Court is entitled to go into the whole of the facts and determine for itself whether sufficient evidence has been adduced to warrant extradition. The position of the matter at the present stage is, shortly, this ; —Lillywhite has applied to be returned Homo via Vancouver, to enable witnesses to identity him_ at Victoria, which is only lour hours’ journey from his old home at Tacoma. But sooner than have the point in question re-argued before the I 1 nil Court—-which he has been given the opportunity of doing—and suffering the necessary delay, he prefers to go to England. The local authorities have cabled to the English police asking them whether they would consent .to Lillywhite’s travelling via America, but have received no reply. Lillywhite has determined that if the authorities reii:se to convey him, via Vancouver he will go Home by the nest direct boat, ine reason for expediting the matter on Tuesday was that his Excellency the Governor, who has to sign the necessary warrants, was going to the King Country, and if that formality had not been complied with during the present week further delay would have been involved.
