WELLINGTON CITY LEASING BILL. NOTICE is hereby given that the Wellington City Council propose to introduce into the General Assembly at its present session a Local Bill intituled as above, the object and purport of which are as follow: 1. To enable the Corporation within one year from the coming into operation of the Act to accept a surrender of any lease granted by it before the coming into operation of such Act of any land situate in the city and not having any building thereon at the lime of the granting of such lease (which lease shall not contain any provisions for renewal or any provisions under which the lessee, his executors administrators, or assigns can receive compensation for any' buildings or improvements! and in exchange for such surrender to grant a new lease of the same land to the lessee 2. Such new lease shall be for a term not exceeding twenty-one years, with provisions for renewal from time to time for successive terms of not exceeding twentyone years, and may be in or to the effect of the form scheduled to the Bill. 3. The rental for the first term under such new lease - shall be the full annual ground rental of the said land that ought to be paid during such first term without reference to any buildings or improvements’ existing on the said land, to be ascertained by' a valuation made by three independent valuers, one appointed hy the lessee, the second by' the Council, and the third by' the two valuers appointed as aforesaid, or made by any two of the said three valuers who shall agree. 4. The lessee shall pay' to the Corporation by' way' of premium a sum representing the prospective interest of tbe Corporation in the buildings and improvements (if any) existing upon such land, to be ascertained by valuation in manner aforesaid. 5. To enable the Corporation within one year after the coming into operation of this Act to accept a surrender of any' lease of any land situate in the city granted by the Corporation before the coming into operation of this Act, reserving only a ground rent and containing any provisions for renewal or any provisions under which the lessee can receive compensation for any buildings, improvements (but under which lease the renewed terms or terms must be submitted to public competition) and to grant to the lessee, in exchange, a new lease under items 2 and 3 of this advertisement, provided that the lessee shall pay to the Corporation by way' of premium a sum representing the increased benefits conferred by tbe new lease, to be ascertained by valuation in manner aforesaid. 6. Item 5 is to extend to leases of city lands granted at ground rents under section 5 of the Wellington Corporation Leaseholds Act, 1885, or under section 9 of the Wellington City Empowering Act, :«»!>. The form of lease given in the schedule to the Bill includes covenants by the lessee to pay tho rent and all city and other rates, and a proviso for re-entry and provisions for renewal of the lease from time to time, the annual' ground rent being valued in manner above mentioned on tho occasion of each renewal, but does not require the renewed leases to be submitted to public competition. The form negatives the implication of any ■ implied covenants, and generally is substantially' in the form known in the city .as the “Te Aro Reclamation Lease/’ Full copies of the above-mentioned Bill and of the said form of lease have this day been deposited in tbe Magistrate’s Court and the City Council Office, both situate in the City of Wellington, and are there open to public inspection during ordinary office hours without fee.
