MAGISTRATE’S COURT.
Friday, January 20. (Before Messrs 0. M. Luke, E. McKenzie and J. Lockio.) MINOB CHABOES.
A first-offending inebriate was convicted and discharged. John Day, charged with theft of a quantity of material the property of Messrs Stewart and Co., was further remanded until the 27th instant. A. L. Smith was fined 5s with 7s costs for laying a drain without being licensed. M. J. Rowley was convicted of assaulting A. T. Mason, and fined 10s with £1 11s costs. CIVIL BUSINESS. Judgment for plaintiffs was given in the following civil cases : —J. May and Co. v. J. J. Grupen, £9 18s 6d, costs £1 5s 6d; TV. Miles v. TV. Walker, £2 15s, costs £2 ss; Macdonald, Wilson and Co. v. W. Von Heisenberg, £l3 10s, costs 20s. The case of J. Gallon v. P. Perrier, claim 19s 6d, was dismissed. Some time was occupied in. hearing a case in which P. J. W. Pear sued H. J. Rodgers for £2O. The case for the plaintiff was that he leased premises in Old Customhouse quay to defendant and sold him certain machinery in the building for £4O, of which £2O was to be paid on January 3rd, and the balance of £2O in three months, being secured in the meantime by.a promissory note. For the defence it was urged that there was a condition of the contract which had not been fulfilled, and that the parties wore never ad idem. . The Bench gave judgment for plaintiff with £4 7s costs. Mr R. B. Williams appeared for plaintiff and Mr Wilford for defendant.
