RESIDENT MAGISTRATE’S COURT.

[Before Messrs W. Halae and J. E. Smith, Justices.) ASSAULT.

Owen Kane pleaded not guilty to a charge of assaulting Dr Chilton. Mr E. Shaw for the accused. Dr Chilton, called, deposed that at about half part II on Sunday evening tbe defendant (a cook at tbe Hospital) came home intoxicated, and witness ordered him off the premise®. Kane bad some sharp instrument

in his hand, with which he inflicted a wound on the back p.t witness’ band. By Mr Shaw : Did hot know whether or not Kane had a breastpin on at the time. The wound was a very tririal' Ona,- although painful. Accused was maudlin*drank. Was not aware- that there had been any difference between Kane and the nureea ou Friday bight. .The steward* on the Sunday before last, was giveunotice to leave, and Sunday was therefore bis last day at the Hospital,. Miss Marsden, the Lady Superintendent, was called, and corroborated the evidence of Dr Chilton; Witness did not see how Dr Obilton received the wound on his band. One of the nurses was also called, and gave evidence as to the intoxication of the accused. Mr Shaw said Kane had a breastpin on al the time when Dr Chilton took bold of bun by the . neck, and no doubt the wound was caused by the breastpin. Dr Chilton, re* called by the Bench, said that whatever instrument made the wound was in the accused’s hand. The accused was sworn, and denied that he struck Dr Chilton, or that he had any instrument upon bis person at the time be was ejected from the Hospital. Wit* ness was not drunk at the time. The Bench considered the atanult bad not been proved, and dismissed the case. B&UNEZNKBP*. Three first offenders were fined 5s each. AX ABSCONDER. William Webdale, a boy of about 14, pleaded guilty to a charge of absconding from the Burnham Industrial School. At the request of Inspector Goodall the case was remanded till next day, in order that the lad’s mother might be communicated with, the Inspector considering there was a probability that she would take the lad home. VXLAVFFULUT ON PREMISES. Jessie {Murray pleaded guilty to being illegally, on the premises of. Mr .Kennedy, in Malgrave-etreefc, and was sentenced to 48 hours' imprisonment. A BREACH OF THE PEACE. Thomas O'Dowd pleaded guilty to charges of having caused a breach of the peace in Willis'Street oa Saturday night, and of using obscene language. He was fined 4')s, in default 14 days’ imprisonment, for the first offence, and sentenced to seven days’ imprison* ment on the second charge. * - A, VAGRANT. : ■ John Fenton, chargt-d with vagranoy, pleaded gnilty. The evidence went to show that the accused, who is said to be well con* neoted, had been banking about the Taita for some time. Ho was discharged on condition that he went to work at once.
