AN INTERESTING CASE.

Auckland, July 12. At the Cambridge Court to-day an interest* ing case, Brindle v. Buckland and others was heard, showing the non-responsibility of stewards and officers fop payment of stakes, Mr Hay appeared for the defendants. Plain* tiff claimed £9 10s, amount of stakes won at the Piako Turf Club Paces on the 30th of November last, by his horse, Robeit the Devil,- Plaintiff stated be had applied for the money to the secretary of the club, Mr George Smith* of Morrinaville, who had said that the money should be paid when the race subscriptions were got in. Messrs Buckland, Evans, Turnbull and Breakell were now summoned as stewards ; but each, when sworn, stated that their names were placed on the list of stewards without their consent and in their absence. A letter was produced by the latter from the secretary of the club stating that he could nob get subscriptions in or he would settle the claim. Mr Hay argued there was no contract between the deendants and the plaintiff, and he quoted authorities to show that even had defendants been proved to be stewards, they were not liable, not being stakeholders ; and that even the stakeholder himself was personally not liable for stakes until be had himself received possession of the money.
