SUPREME COURT.—NISI PRIUS.

Thursday, January IC. (Before His Honor the Chief Justice and a special jury.) The Court re-opened at 10 o’clock. I.I‘LEAN V. NICHOLSON. For plaintiff—Mr. F. M. Ollivier, with him Mr. Fitz Gerald. For defendant—Mr. Travers. In this case, Alfred Henry McLean, draper, out of business, is plaintiff, and Mr. Nicholson, of Cuba-atreet, cabinet-maker, &c., defendant. The plaintiff seeks to recover damages to the amount of £I2OO, the same being claimed under four separate counts—namely, £SOO on the first for libel, £l5O on the second for breaking and entering, £SOO on the third for breaking and entering a dwelling-house, and £SO on the fourth for assault. On the application of Mr. Travers, the witnesses on both sides were ordered out of Court. Mr. Fitz Gerald opened the proceedings, after which ■ Mr. Ollivier stated the plaintiff’s case to the jury. Evidence was then gone into, but as the matters involved have been before the public in various forms of litigation for some months past, it is unnecessary to recapitulate the circumstances. A number of witnesses were examined, and the further hearing of the case was adjourned until ten o’clock this morning.
