Tho Arawata, with the English malls, sailed today. Tho steamer Tararua, from Melbourne via tho South, Is due hero to-day, and leaves again the same day for Sydney via Napier and Auckland, taking tho outward San Francisco mall for transhipment. The schooner Auro;a, which left hero about a fortnight aSo for tho East Coast, camo into harbor yesterday morning, being unable to hold communication with tho shore, She has been dodging on and off Flat Point over since. She will return again by tho first change of wind. The steamer Wanaka, from Auckland via tho East Coast, arrived in harbor at 11 yesterday forenoon. She loft Auckland on tho 30th ultimo at 4.30 p.m.; arrived at Tauranga tho next morning, and loft again at 10.15 a.ra.; loft Poverty at 6 p,m. on the Ist, and Napier at 1 p.m. on Wednesday, Tho Manawatu, from Wanganui, arrived In harbor at 8 o’clock yesterday morning, after n. fourteen hours’ passags. She experienced a head wind and hoavy beam sea on tho way up. The Taiaroa, from Onehunga via Taranaki and Nelson, is duo early this morning. Tho Spec, schooner, cleared tho Customs yesterday tor Polorus Sound, and sails to-day. She returns to Foxton immediately she comes off. SHIPOWNERS' LIABILITIES. Since tho first shock of tho recent calamity on th* Thames has passed away a good deal of attention has naturally been directed to the provisions of tho Merchant Shipping Acts relating to the limitation of the liability of the shipowners for damages for loss of life or personal injury. Tho general scope nf those provisions will be known to our readers ; but it may ha worth wbild to draw attention to tho course adopted by the Chancery division of the High Court In exercising Its useful jurisdiction, under section 514 of tho Merchant Shipping Act, 1851, of entertaining proceedings at the suit of a shipowner against whom numerous claims for damages are made or apprehended, for the puiposo of determining the amonntof his liability, and distributing tho amount recoverable from him among the several claimants. According to section 54 of the Merchant Shipping Act, 1862, tho damages recoverable in respect of loss of lifo or personal Injury, "either alone or together, with loss or damage to ship, boats, goods." Ac , are limited (where the owner is not actually In fault) to an aggregate amount not exceeding £l3 for each ton of the ahlp’fi tonnage. Tho course adopted in the Chancery chambers In an action under section 514 of the Act of 1854 was clearly laid down by tho late Master of the Rolls In Olaholm v. Barker (14 W. E. 1008). Tho total amount for which tho owner Is liable is first taken at £ls per registered ton of tho ship. Than tho course Is to ascertain the damage suffered by each person as it there were no limit to the owner's liability, and when this damage has been so ascertained tho sum for which tho shipowner Is UabWis applied In payment of the damages ; if the amount of damages Is equal to, or less than, the amount of liability, all the claimants are paid in full, the balance In the latter case being paid to the shipowner ; but if tho aggregate amount of damage is greater than the sum ;for which tho shipowner is liable, tho amount for which ho la liable is paid rateably among the claimants in proportion, to the amount of their damages. Interest will bo added to tho amount lor which tho shipowner Is liable, and U seems that ho will also bo liable beyond the statutory limit for tho cost of assessing the damages. Lord Solborne stated, in a case of this kind heard In 1372, that tho experience gained in Glaholm v. Barker had shown that all the claims in actions of this description might be settled in Chambers without incurring much expense.— Solicitors' Journal.
