In Banco on Friday, the Chief Justice heard argument on an originating summons brought by Martha Fenwick, widow of the late Charles R. Fenwick, of Featherston, against the trustees* and beneficiaries under her husband’s will, for an order praying for further provision out of the testator’s estate, under the pro visions of the testator’s Family Maintenance Act, 1900. Mr Myers appeared in support of the application and Mr Izard for the trustees. Plaintiff’s affidavits set forth that the value of the estate was about £3400. Testator had been twice married, and the whole of tho property was bequeathed to his .children by liis first marriage, subject to the payment of 10s per week to the widow.
