On Saturday morning the Chief Justice gave judgment in the preliminary points raised in the case of Brown v. Teare. the plaintiff. John Henry Brown, claiming £2OOO damages against Dr Teare. gaol surgeon, for an alleged unskilful operation during the formers incarceration in the Terrace prison. The alleged unskilful operation was performed shortly after Brown had been sent to the prison. He had been released after six years. The defence claimed that the Statute of Limitations 21. James 1., and the Mercantile Law Amendment Act barred the action. • His Honor decided that the six years laid down by the Statute of Limitations did not begin to run until a prisoner was released from custody. The “New Zealand Illustrated Magazine” this month maintains its high standard of excellence. “In the Public Eye” are Captain F. W. Hutton (curator of the Christchurch Museum), Mr H. G. Ell, M.H.R., Mr P. S. Hay (superintendent engineer of the Makohine viaduct), the late Mr AY. S. Wilson (of Auckland) and Mr J. G. Wilson (president of the New Zealand Farmers’ Union). The editor (Mr Thomas Cottle) contributes an interesting narrative of the birth, life aud death of a predecessor some forty years ago of the present magazine. The short stories are ‘The Wooing of Hine-ao,” by J. C. An. dersen, and a sketch, “Judy,” by Edith G. Woolcott. The music and words of the old pioneer se3 song of the “Charlotte Jane” are reproduced. The interest of the usual monthly columns is maintained.
