COURT OF APPEAL.
The half-yearly sessions of the Court of Appeal were opened in the Supreme Court at 11 o'clock on Monday forenoon. Mr Justice Biehmond was the only Judge absent from the Bench (the Chief Justice presiding ,as usual), while the Bar was represented by Sir Bobt. Stout, Messrs Edwards, Skerreti, E. D. Bell, E. B. Brown, G. Hutchison, Morison and M. Chapman (Wellington) and J.Hosking (Dunedin). It was found impossible to proceed with any of the cases on Monday, the counsel engaged in some instances not having arrived, and others being unprepared through one cause or another.
In the case of Cattell v. the New Zealand Native Land Settlements Company, Mr Edwards obtained leave on the usual terms to appeal to the Privy Council. On the application of Sir Robt. Stout the case of Airini Tonore v. Davy and others (which he described as another phase of the Mangaohane case) was set down on the cause list.
Another stage in the protracted litigation over the Horowhenua Block was reached on the 24th when the appeal entered by Warena te Hukeke, otherwise known as Warena Hunia, against the judgment delivered in December last in favour of the trust alleged by Meiha Keepa te Rangihiwinui (Major Kemp) and other natives of the Maopoko tribe came on for argument at the Court of Appeal. Mr Justice "Williams, Mr Justice Conolly and Mr Justice Denniston constituted the Bench. Mr Barnicoat (Wanganui) and Mr Morison appeared for the appellant, and Mr Edwards and Mr Skerrett for the respondents. Mr Barnicoat had not concluded hia argument in support of the appeal when the Court, at 4.30 p.m., adjourned till next morning.
