In the qase of the Midland Perambulator Company (an English company) y. Edwin Arnold, a claim of £313 13s 4d for goods. sold and delivered, Mr J. P. Campbell, solicitor for the defendant, received a.' cablegram on Wednesday from his London agents informing him'that the writ and all subsequent proceedings have been set aside by an order of the Queen's Bench Division of the High Court of Justice in England, on the ground that the goods in respect o£ which the Claim is made were to be paid, for at Wellington, and not in England, and that therefore the High Court of justice in England had no jurisdiction to issue the. writ. Mr Arnold, in addition to the*' technical defence which he pleaded oh Mr' Campbell's advice, on which plea the writ has been sec aside, claims to have a good defence on ■ the merits, on the ground of over-charges, &c. The result of the present proceedings is, that if the Perambulator Company wish to proceed against Mr Arnold, it will have to pay the cost of the present abortive pro- ■ ceedings, and to issue its writ in the NewZealand Law Courts, in which Mr Arnold • will he able to .adduce his own evidence and that of his witnesses without the cost and inconvenience attendant upon the issue of a commission from the Higb Court of Justice in England.
