CHARGE OF ASSAULT.

_* (press association.) New Plymouth, May 10. Goodman, a recently created J.P., waa charged this morcing, at the Resident MagCourt, with having assaulted James C. George. Goodman wao further charged with using profane, indecent and obscene language in a public place. George gave evidence that the defendant struck him on the back in front of the Government Build= ings, and used the words, 'lam still alive, d—<- you.' *I will pull your nose next time you insult me in your office,' and other forcible expressions. In orosß-examination the plaintiff admitted that he had some days before that he was very muoh disgusted With his action in- signing an affi davit to the effect that the Grand Jury would not find a true bill in the dummyism cases, whioh was insulting to the com. nmnity. The Grand Jury did find true biiis in all the cases. He wrote the words down in a bobTt at the time they were uttered, and Knight, who waß with him, initialled the memo. Knight gave corroborative evidence, saying that Goodman knocked the wind out of Gecrge with the blow. The case is still proceeding. Later, In the Court oase against Goodman, J P., for assault, the justices said they considered the offence was of a trivial nature, and dia* missed the information. A similar decision was given in the cose of using obscene language, brought pgainst the same defendant.
