WIFE DESERTION.

(UNITED PRESS ASSOCIATION.) Christchurch, June 15. W. H. Messenger, the absconding publican, appeared at the Resident Magistrate’s. Court to-day, charged with deserting his family and-, going to reside outside the Colony* IVIr lMartin, for the prosecution, applied for a withdrawal of the charge, as Messenger and wife hadbeen reconciled. Mr S ringer, for Messenger,, called attention to a defect in the legislation, which would be fatal to the prosecution. The Destitute Persons Amendment Act, 1884,. under which the information was laid, made no provision for the wife to give evidence against her husband. It would therefore be practically impossible to prove the charge, as the wife would be a necessary witness. . Mr Beetham, 8.M., said he would give his decision to-morrow.
