THE NAPIER CONSPIRACY CASE.

In the Resident Magistrate's Court, Napier, on Friday, the case of conspiracy against J. G. Kinross and G. B. Worgan was called. Mr. Macdonald, representing Mr. Kinross, said he had appeared to answer the charge, though he had received a notice from the solicitor for the prosecution to the effect'that it would be withdrawn. His Worship read a letter received by birn from Mr. De Lautour, on behalf of the counsel for the prosecution, to the effect that the prosecution would bo discontinued, and the matter brought before Parliament. Mr. Macdonald said he would remind the Court that this was the second time this case had been brought before the Court and abandoned by the prosecution, ufter repeated adjournments. On the former occasion, as on this, no one apDeared to support the charge, and it simply "fell through. He thought it would only have been respectful to the Court if a solicitor had appeared. His client could obtain no redress, for even if he took proceedings and obtained judgment against the Maori in whose name the prosecution had been undertaken, under the present law of the colony he would have no means of enforcing the judgment. The Resident Magistrate said that there being no appearance of the prosecution, the case must be dismissed.
