LEGAL DEFINITION
NEW ZEALAND ALLIANCE OBJECTS NOT CHARITABLE (P.A.) DUNEDIN, Wednesday ' Judgment was given by Mr Justice Kennedy today in a case in which the riding of the Supremo Court was sought on the question whether the New Zealand Alliance for the Abolition of Liquor was a religious or charitable trust under the terms of the Religious and Charitable Trusts Act. The Commissioner of Stamps had determined that the bequest by Frederick Jago, of £SOO to the alliance was not a bequest of property on a charitable trust in New Zealand within the meaning of the Death Duties Act. His Honor held that as the dominant object of the alliance was to secure legislative change by force of vote that was a political object, and the objects of the alliance wore not in a legal sense charitable. In his view the determination of the Commissioner of Stamps was correct and would ho affirmed. The appellant was ordered to pay respondent £ls 15s and disbursements.
