His Honor said the main facts were not in dispute—that plaintiff was permanently and totally disabled as a result of his injuries, not even having been able to appear as a witness. The main question was whether the council remained his employer when he was doing work for the Transport Company. He decided that this was the case and that the council was liable to the extent of paying compensation to plaintiff at the rate of £3 9s 9d a week. Such compensation had already been paid for 43 weeks, but arrears must be paid to date. His Honor suggested that counsel could agree on the fixation of a lump sum. Seventeen guineas costs were allowed against the defendant council. Mr. F. H. Haigh, of Auckland, acted for the plaintiff, Messrs. Tompkins and Wake, of Hamilton, for the council, and Messrs. Gillies, Tanner and Fitzgerald for the company. GROWING VEGETABLES (P.A.)
