SHOT IN THIGH
YOUTH WITH FIREARM "BIT OF TOM FOOLERY" (0.C.) PALMERSTON NORTH, Monday In November last two youths, Peter Gilbert Allen and Maitland Dale, went shooting in the hills at the back of Palmerston North. The trip ended in Dale being shot through the fleshy part of the thigh by a rifle in the hands of Allen. When the latter was charged in the Magistrate's Court with presenting a firearm at Dale, Allen said both were playing at the time. He pointed the rifle at Dale, but did not expect anything to happen. He could not remember pulling the trigger. Dale's account of what happened was that be was lying down and decided on "a bit of tomfoolery." He drew his sheath knife and swung it in Allen's direction. He thought this action had caused Allen to involuntarily swing the rifle round. Both had been surprised when he was shot. Mr. H. P. Lawry, S.M., did not enter a conviction, saying that it was evidently the shock of seeing the sheath knife coming that caused Allen to bring the rifle round. There was no intention to present the weapon at Dale.
