DIVORCE GRANTED
GROUND OF SEPARATION WIFE OPPOSES PETITION The petition of .Albert Leslie TCiley (Mr. C. A. Sneddon) for divorce from Esther Mnr.v T?iley (Mr. Tong) was contested before 'Mr. Justice Johnston in the Supreme Court yesterday. The petition was based 011 the existence between the parties of a separation order that had been effective since .January 22, 10M7. The answer of the respondent alleged that the separation was dw to petitioner's wrongful conduct. After hearing evidence, His Honor said the real question was whether it had been proved that the separation was due to the wrongful act or conduct of the petitioner. There was not sufficient proof of drunkenness or cruelty in this case to show that they were the cause of the separation. The quarrels between them did not appear to have been caused solely by the conduct of the petitioner. His Honor was satisfied that the right given to a party—even if he were a guilty party—to apply for divorce after separation for three years should not he taken away on such slight evidence. A decree nisi would therefore be granted to the petitioner, with costs on the lower scale.
