APPEAL UPHELD

An appeal against a decision of Mr. J. A. Gilmour, S.M., in connection with the interpretation of the New Zealand engine-drivers, firemen and greasers' (general section) award, lias been upheld by the Arbitration Court. An appeal was filed bv Winstone, Limited, against a ruling given by Mr. Gilinour that a senior crusher worker could be considered substantially in charge of plant, and was entitled to be paid £5 Is (3d a week. The application was lodged 011 the ground that the decision was erroneous in law. The judgment of the Court, delivered by Mr. Justice Tyndall. was that the greater proportion of the time of the worker concerned was occupied in work outside the scope of the engine-drivers' award. He was not entitled to the £5 Is Gd a week prescribed 111 the award.
