BANKRUPTCY CASES

DISCHARGE REFUSED Several bankruptcy matters were decided by Mr. Justice Fair in the Supreme Court yesterday. The application of D'Arcy Wood, of Auckland, builder, for discharge from bankruptcy was supported by Mr. Bennett, who said the failure had been brought about through Wood embarking on building enterprises when conditions ' were most unfavourable. He was at present a land salesman. His Honor said the bankrupt had incurred liabilities to the extent of £2OOO in the course of 12 months' trading, and he was unable to repay any portion of it. He did not appear to be the type of man who should he in business on his own account.

In dismissing the application, His Honor said the applicant must wait some further time and show evidence that he was unlikely, if granted a discharge, to incur fresh liabilities he was unable to meet.

The bankruptcy notice of R. V. Thompson, of Auckland, insurance clerk (Mr. W. W. King), was set aside, and a declaration made that he had not committed an act of bankruptcy. He was required to pay costs. Discharge from a bankruptcy of 17 years' stauding was granted to Robert Fewoll, of Auckland, salesman (Mr. S. 11. Mason), and Joseph William Hodgson, of Auckland, retired butcher (Mr. Wheaton), was granted an order annulling his bankruptcy. An order was made adjudicating Gr. W. A. Pickering, of Woodhill, storekeeper, bankrupt.
