MOTOR-CYCLIST FINED
CHARGE OF INTOXICATION Tlie defence that he was not in charge of the machine at the time of the offence was entered on behalf of William Anthony Fitzgerald, aged <3l, a freeing works employee (Mr. Aekins), who pleaded not guilty in the Police Court yesterday to being in a state of intoxication in charge ot a motor-c.vcle in Khyber Pass Road on 1 Police evidence was given that accused was seen near the machine with another man. He was then drunk. Shortly afterward accused s friend unsuccessfully tried to start the motorevcle arid a constable then told accused to go home. Later in the afternoon the constable saw accused startinn- the machine and preparing to push it oft The officer told him to stop the engine and. finding him intoxicated, arrested him. . Mr Aekins saul accused had no intention of taking the machine away and was going to put it on its stand. He bad none home understanding that his friend would bring the motor-cycle and had later returned to find it still in the street, ~ ~ . ~ Mr J. Moiling, S.M., said he could not accept the defence. Accused was convicted and fined £2O. His licence was cancelled arid he was prohibited from obtaining another for a year.
