ALLEGED ENTRY OF GARAGE

Charged with being a rogue and n vagabond, rtnd with breaking and entering a service station at 221 Great North Road, Grey Lynn, owned by Herbert Valentine, on the night of July 15, with intent to commit a crime, James Davidson Ireland, labourer, aged 24 (Mr. Robinson), appeared for trial before Mr. Justice. Callan in the Supreme Court yesterday. Mr. G. S. R. Meredith appeared for the Crown. Keith Winston Churchill, a shop assistant, said that early on the morning of Sunday, July 16. he drove his car into Valentine's garage, where he usually- parked it. When sitting in the car lie heard a noise at the back of the garage and then saw a man in a leather coat and dark suit pa.ss his car. The man tried the front doors and another door, and subsequently went to a bench where batteries were stored. Witness added that lie then left the garage by the front doors to see if lie could get assistance. No one being about, witness returned and slammed the doors. Later, when he was talking to a pedestrian, he saw a man coming from the back entrance of an adjacent section in Elgin Street. This man was in a leather overcoat and dark suit. He got into a small car and drove away. The case was adjourned until to-dav.
